HOLDEN BOARD OF SELECTMEN
EXECUTIVE SESSION MEETING MINUTES
JUNE 20, 2011

7:19 PM                                                         Senior Center Conference Room

Chairman Lavigne opened the meeting at 7:19PM.

Approval of Previous Minutes

The Board reviewed the April 19, 2011 executive session minutes.  The minutes could not be approved due to lack of a quorum.  They will be presented at the next executive session meeting.

Motion by Sel. O’Brien, seconded by Sel. Lipka, it was UNANIMOUSLY VOTED TO APPROVE AND RELEASE THE MAY 10, 2011 EXECUTIVE SESSION MINUTES AS PRESENTED.

Collective Bargaining/Litigation Update

The Manager updated the Board on the Cripps dog issue.  Attorney Jessica Murphy reports that the permanent court injunction has been signed.  The Manager reported that all executive session minutes regarding the Cripps that have been approved would be released.

The Manager said that counsel had filed a motion for a stay in court for Sherrill vs. Wrinkle.

The Manager updated the Board regarding the ongoing WRSD lawsuit by abutters regarding the wind tower located at the high school.  The Holden ZBA had been included in the lawsuit.  The District installed some other type of wind tester making the lawsuit mute.  Attorney Davidson is attempting to extricate the Holden ZBA from the lawsuit seeing that the issue is now null and void.

The Manager reported that a lawsuit filed by a resident on Reservoir Street who received misinformation from a zoning map in the assessors office in regards to a zoning variance has not progressed.

The Manager provided the board with an update on collective bargaining efforts.  The HMLD settled its contract for one year.   The Fire Department is asking for a three-year contract and TM is currently in negotiations.  The Manager has asked for a “reopener” in the negotiations for both HMLD and FD based on pending health insurance litigation in the House and Senate.  Non-union personnel will receive a 2% increase on July 1, 2011.  This increase is in-line with union increases.  The Assistant Town Manager is involved in all union collective bargaining negotiations.  The group discussed health insurance costs and the GIC option.

Motion by Sel. O’Brien, seconded by Sel. Lipka, it was UNANIMOUSLY VOTED TO RECESS TO REGULAR SESSION FOR ADJOURNMENT PURPOSES ONLY AT 7:47PM.  Roll Call: O’Brien: yes; Lipka: yes; Jumonville: yes: Lavigne: yes.
